TERMS AND CONDITIONS
1. GENERAL PROVISIONS
1.1 The following contractual provisions (Terms and Conditions) apply to all contracts concluded with the customer (hereinafter: “CUSTOMER”) via the order form of TEX Fishing Limited, Suite 6285, Unit 3A, 34-35 Hatton Garden, Holborn, London EC1N 8DX, United Kingdom (hereinafter: “TEX Fishing Limited”) under the domain www.cat-tex.com.
1.2 These Terms and Conditions contain special provisions for customers who are traders within the meaning of the Consumer Rights Act 2015 (hereinafter: “BUSINESS CUSTOMERS”). These special clauses for commercial transactions are identified by explicit reference to BUSINESS CUSTOMERS and do not apply to transactions with consumers.
1.3 TEX Fishing Limited does not accept any deviating terms and conditions of the customer unless expressly agreed to in writing.
2. CONCLUSION OF CONTRACT
2.1 The CUSTOMER can access the order form at www.cat-tex.com and initiate the ordering process.
2.2 Input errors can be corrected during the ordering process. The process may be cancelled by closing the browser window.
2.3 Product displays are a non-binding invitation. The CUSTOMER’s order is a binding offer.
2.4 Order confirmation is automatic but not contractual. Acceptance occurs by email or dispatch of goods within 5 working days.
2.5 Contract concluded with TEX Fishing Limited.
2.6 Contract language: English.
3. CONTRACT TEXT STORAGE
3.1 The contract text is stored by TEX Fishing Limited. Order details are emailed to the CUSTOMER. Terms and Conditions are accessible online.
4. RIGHT OF CANCELLATION
4.1 Consumers have statutory cancellation rights under UK law. Full details are in the cancellation policy presented during ordering.
5. PRICES AND DELIVERY COSTS
5.1 Valid prices are those displayed on the order date.
5.2 Prices are in GBP and include VAT.
5.3 Delivery costs:
Free for orders over £50
£4.99 for orders under £50
5.4 Additional duties/taxes may apply for non-UK deliveries.
6. PAYMENT TERMS
6.1 Only listed payment methods accepted.
6.2 Bank transfer: Payment before dispatch.
6.3 Invoice: Due immediately, payable within 30 days. Late Payment legislation applies.
6.4 Card Payments: Subject to SCA under Payment Services Regulations 2017.
6.5 PayPal: Requires PayPal login and completion.
6.6 Direct Debit: Returned payments incur bank charges payable by CUSTOMER.
6.7 BUSINESS CUSTOMERS may only offset with legally recognised or accepted claims.
7. DELIVERY AND SHIPPING CONDITIONS
7.1 Delivery by Royal Mail or courier.
7.2 BFPO delivery possible only by arrangement and bank transfer.
7.3 Delivery time starts after order or payment confirmation.
7.4 Risk passes to BUSINESS CUSTOMERS upon dispatch to carrier.
7.5 Risk passes to consumers upon handover.
7.6 Delivery within UK mainland only.
7.7 Undeliverable items returned due to CUSTOMER’s fault will incur reshipping charges.
8. RETENTION OF TITLE
8.1 Goods remain TEX Fishing Limited’s property until fully paid.
8.2 No resale, assignment, or pledge until full payment. Notify TEX Fishing Limited if third-party access occurs.
8.3 TEX Fishing Limited may reclaim unpaid goods.
9. WARRANTY AND LIABILITY FOR DEFECTS
9.1 Consumer rights protected under the Consumer Rights Act 2015.
9.2 BUSINESS CUSTOMERS must inspect goods and notify defects within 7 days.
9.3 Defect claims for BUSINESS CUSTOMERS limited to 12 months.
10. LIABILITY
10.1 Liability excluded except for:
Intent or gross negligence
Death or injury by negligence
Statutory consumer protection obligations
10.2 Liability limited to foreseeable loss in contract breaches.
10.3 Consumer Protection Act 1987 rights remain unaffected.
11. PRODUCT SAFETY
11.1 Products include sharp hooks and metal parts.
11.2 Adult supervision required for users under 18.
12. SKILLS CAMPS
12.1 Participants must be 18+.
12.2 Outdoor activity risks accepted by participants.
12.3 Payment Terms:
Full payment required for bookings within 6 months
Deposits (non-refundable) for bookings beyond 6 months
Final balance due 3 months before event
12.4 Weather cancellations fully refunded or rescheduled.
12.5 Photo ID required at check-in.
13. RETAILER TERMS
13.1 Retailers must preserve product accuracy and quality.
13.2 Retailers may not:
Undercut prices without permission
Rebrand or misrepresent products
Sell outside approved areas
13.3 Breach may lead to instant termination.
14. INTELLECTUAL PROPERTY
14.1 TEX Fishing Limited trademarks/designs protected under UK law.
14.2 Unauthorised use will result in legal action.
15. DATA PROTECTION
15.1 Personal data processed in accordance with the UK GDPR and Data Protection Act 2018.
16. ALTERNATIVE DISPUTE RESOLUTION
16.1 Consumers may use the EU’s ODR platform.
16.2 TEX Fishing Limited does not participate in ADR schemes. Consumers may pursue Trading Standards or legal remedies.
17. GOVERNING LAW AND JURISDICTION
17.1 English law governs all contracts.
17.2 BUSINESS CUSTOMERS: Jurisdiction lies with English courts.
17.3 Consumers: May also choose courts in their country of residence.
